Please read this agreement carefully before signing. This document outlines the terms and conditions of your residency at Diamond Sober Living.

1.Parties to the Agreement

This License Agreement ("Agreement") is entered into between Diamond Sober Living ("Provider") and the individual named on the intake form ("Resident"). This Agreement governs the terms of the Resident's occupancy at the Diamond Sober Living facility located in Florida.

2.Nature of Occupancy

This Agreement constitutes a license to occupy, not a lease. The Resident is granted a revocable, non-exclusive license to occupy a designated bed space within the sober living home. This Agreement does not create a landlord-tenant relationship. The Resident acknowledges that Diamond Sober Living is a structured recovery residence and that continued occupancy is contingent upon compliance with all program rules and requirements.

3.Program Fees

The Resident agrees to pay the program fee as established at the time of intake. Fees are due on the 1st of each month. A grace period of three (3) days is provided. Fees not received by the 4th of the month may result in discharge. All fees are non-refundable. The Provider reserves the right to adjust program fees with thirty (30) days written notice.

4.Program Requirements

As a condition of residency, the Resident agrees to: (a) maintain complete abstinence from alcohol, illegal drugs, and non-prescribed mood-altering substances; (b) attend a minimum of three (3) recovery support meetings per week and provide written verification; (c) attend all mandatory house meetings; (d) comply with all curfew requirements as outlined in the House Rules; (e) actively participate in employment, education, or a structured treatment program; and (f) work with a sponsor or recovery support person.

5.Drug & Alcohol Testing

The Resident consents to random and for-cause drug and alcohol testing at any time during their residency. Testing may be conducted using urine, breath, or other approved methods. Refusal to submit to testing will be treated as a positive result and may result in immediate discharge. The cost of testing may be the responsibility of the Resident.

6.Termination of Agreement

This Agreement may be terminated by the Provider immediately and without prior notice for: (a) any use of alcohol or controlled substances; (b) refusal to submit to drug/alcohol testing; (c) violence, threats, or harassment; (d) theft or destruction of property; (e) failure to pay program fees; or (f) any conduct that jeopardizes the safety or recovery of other residents. The Resident may voluntarily terminate this Agreement with 24 hours written notice. Upon termination, the Resident must vacate the premises within the time specified by staff.

7.Personal Property

The Resident is responsible for their own personal property. Diamond Sober Living is not liable for loss, theft, or damage to any personal belongings. The Resident agrees not to bring firearms, weapons, or any prohibited items onto the premises. Upon discharge or voluntary departure, the Resident must remove all personal property. Items left behind for more than 72 hours may be donated or disposed of.

8.Confidentiality

Diamond Sober Living respects the privacy of all residents. Information about a Resident's participation in the program will not be disclosed without written consent, except as required by law or in cases of imminent safety risk. The Resident likewise agrees to maintain the confidentiality of all other residents and not to disclose identifying information about fellow residents to outside parties.

9.Release of Liability

The Resident acknowledges that participation in a sober living program involves inherent risks. The Resident voluntarily assumes all risks associated with their residency and releases Diamond Sober Living, its staff, agents, and affiliates from any and all claims, damages, or liability arising from their participation in the program, except in cases of gross negligence or willful misconduct.

10.Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under this Agreement shall be resolved in the appropriate courts of the State of Florida.

11.Acknowledgment

By signing this Agreement (or by submitting the intake form), the Resident acknowledges that they have read, understood, and agree to all terms and conditions set forth herein. The Resident further acknowledges that they enter this program voluntarily and understand that compliance with all rules and requirements is mandatory for continued residency.
